Flanders Scientific, Inc. does not represent or warrant that the functions contained in the site will be uninterrupted or error-free, that defects will be corrected, or that this site or the server that makes the site available are free of viruses or other harmful components. Flanders Scientific, Inc. does not make any warranties or representations regarding the use of the materials on this site in terms of their correctness, accuracy, adequacy, usefulness, timeliness, reliability, or otherwise. Limitation of Liability

Flanders Scientific, Inc. shall not be liable for any special or consequential damages that result from the use of, or the inability to use, the materials on this site or the performance of the products, even if Flanders Scientific, Inc. has been advised of the possibility of such damages. Applicable law may not allow the limitation or exclusion of liability for incidental or consequential damages, so the above limitation or exclusion may not apply to you.

Product Warranty

All new Flanders Scientific (FSI) monitors come with a two-year warranty, parts and labor, covering manufacturer defects. This warranty does not cover damage resulting from improper use, care, or handling of the monitor, nor normal wear and tear associated with typical use.

RMA shipping charges for items sent to FSI are the responsibility of the customer, and all RMA shipments should be fully insured by the customer. Risk of loss and damage transfer to FSI only after receipt and inspection of your return shipment. FSI will ship warrantable repairs back to you at our cost and will reciprocate the shipping priority used by you to send the unit in for repair (e.g., if you send a unit in for repair using ground service we will return it using ground service; if you use overnight we will return it overnight).

Flanders Scientific (FSI) will make every reasonable effort to repair products covered under warranty. However, if a product is deemed irreparable — due to factors including, but not limited to, the unavailability of replacement parts — FSI reserves the right to offer a pro-rated credit toward the purchase of a replacement unit. The value of this credit will be determined based on the remaining warranty period and the condition of the returned equipment at the time of evaluation.

Return and Refund Policy

We accept returns for refund within 10 calendar days of delivery. Additionally, we accept returns for store credit or exchange within 30 calendar days of delivery.

Please note the following conditions regarding returned items:

  • B-Stock items are sold "As Is" and are not eligible for refund unless specifically agreed to by FSI before sale. B-Stock items may be exchanged within 30 calendar days of purchase for store credit.
  • We rarely charge a restocking fee, but we reserve the right to charge up to a 15% restocking fee.
  • The return policy is designed to allow you to evaluate an FSI product at minimal financial risk. To prevent abuse of the return policy, you may only return one of each model type for refund. For example, you cannot purchase and return three of the same monitor model. We strongly suggest that customers interested in evaluating an FSI monitor for multiple-piece purchases start by purchasing a single unit for evaluation so they may return that unit for refund should it not be suitable for the application in question.
  • Refunds, store credits, and exchanges are contingent upon inspection of item(s) once we receive them.
  • You must obtain an RMA number from FSI before shipping your return product to FSI. Return shipments not accompanied by a valid RMA number will not be accepted or eligible for refund, return, or exchange.
  • Customer is responsible for all return shipping costs.
  • All reseller and system integrator sales are final.

International Customers: If you return a product to us, you will be the exporter from the destination country. Title and risk of loss transfer to us upon our receipt of the undamaged merchandise.

If an item is received damaged or is incorrectly shipped by us, please contact Customer Support immediately (within 24 hours) so that we can resolve the issue in a timely fashion.

Pricing and Typographical Errors

In the event that a Flanders Scientific, Inc. product is mistakenly listed at an incorrect price, Flanders Scientific, Inc. reserves the right to refuse or cancel any orders placed for the product listed at the incorrect price. Flanders Scientific, Inc. reserves the right to refuse or cancel any such orders whether or not the order has been confirmed and your payment method charged. If your payment method has already been charged for the purchase and your order is cancelled, Flanders Scientific, Inc. shall issue a credit to your payment method in the amount of the incorrect charge.

Term and Termination

These terms and conditions are applicable to you upon your accessing the site and/or completing the registration or shopping process. These terms and conditions, or any part of them, may be terminated by Flanders Scientific, Inc. without notice at any time, for any reason. The provisions relating to Copyrights, Trademarks, Disclaimers, Limitation of Liability, Indemnification, and Miscellaneous shall survive any termination.

Use of Site

Harassment in any manner or form on the site, including via e-mail, chat, or by use of obscene or abusive language, is strictly forbidden. Impersonation of others, including a Flanders Scientific, Inc. employee, host, or representative, as well as other members or visitors on the site, is prohibited. You may not upload to, distribute, or otherwise publish through the site any content which is libelous, defamatory, obscene, threatening, invasive of privacy or publicity rights, abusive, illegal, or otherwise objectionable, which may constitute or encourage a criminal offense, violate the rights of any party, or which may otherwise give rise to liability or violate any law. You may not upload commercial content on the site or use the site to solicit others to join or become members of any other commercial online service or other organization.

Participation Disclaimer

Flanders Scientific, Inc. does not and cannot review all communications and materials posted to or created by users accessing the site, and is not in any manner responsible for the content of these communications and materials. You acknowledge that by providing you with the ability to view and distribute user-generated content on the site, Flanders Scientific, Inc. is merely acting as a passive conduit for such distribution and is not undertaking any obligation or liability relating to any contents or activities on the site. However, Flanders Scientific, Inc. reserves the right to block or remove communications or materials that it determines to be (a) abusive, defamatory, or obscene, (b) fraudulent, deceptive, or misleading, (c) in violation of a copyright, trademark, or other intellectual property right of another, or (d) offensive or otherwise unacceptable to Flanders Scientific, Inc. in its sole discretion.

Indemnification

You agree to indemnify, defend, and hold harmless Flanders Scientific, Inc., its officers, directors, employees, agents, licensors, and suppliers (collectively the "Service Providers") from and against all losses, expenses, damages, and costs, including reasonable attorneys' fees, resulting from any violation of these terms and conditions or any activity related to your account (including negligent or wrongful conduct) by you or any other person accessing the site using your Internet account.

In an attempt to provide increased value to our visitors, Flanders Scientific, Inc. may link to sites operated by third parties. Even if the third party is affiliated with Flanders Scientific, Inc., Flanders Scientific, Inc. has no control over these linked sites, all of which have separate privacy and data collection practices, independent of Flanders Scientific, Inc. These linked sites are provided for your convenience and you access them at your own risk. Nonetheless, Flanders Scientific, Inc. seeks to protect the integrity of its website and the links placed upon it, and welcomes any feedback about its own site or sites it links to (including if a specific link does not work).

Governing Law and Jurisdiction

Your use of this site shall be governed in all respects by the laws of the State of Georgia, U.S.A., without regard to choice-of-law provisions, and not by the 1980 U.N. Convention on contracts for the international sale of goods. You agree that jurisdiction over and venue in any legal proceeding directly or indirectly arising out of or relating to this site (including but not limited to the purchase of Flanders Scientific, Inc. products) shall be in the state or federal courts located in Fulton County, Georgia. Any cause of action or claim you may have with respect to the site (including but not limited to the purchase of Flanders Scientific, Inc. products) must be commenced within one (1) year after the claim or cause of action arises. Flanders Scientific, Inc.'s failure to insist upon or enforce strict performance of any provision of these terms and conditions shall not be construed as a waiver of any provision or right.
